Was the painting technically published at the time, before 1923? "Published" in the sense of: shown at a public exhibition, and/or reproductions printed somewhere? In that case it's PD already now. And personally I wouldn't bother too much about those remaining few months until the end of this year either. In the worst case, I agree a good fair use case can be made, as this specific painting apparently has an interesting backstory that involves stylistic comparison between it and certain other pictures by Gauguin and Van Gogh. Apparently there's significant coverage in the literature of how Bernard was accusing Gauguin of plagiarism over it. Disscussing this or similar topics gives us a classic, bulletproof Fair Use case. This would just need to be spelled out more explicitly in the fair use rationale(s). – That said, can you please avoid swearing and cussing? I think, at this time, this is more of trying to "witch-hunt" than contributing to the project. I'm not going to interfere on this any more -- in 2012, which I might survive, all those pics would be free PD, anyways.
